My guess is that to attract a hotel chain, you need to place the hotel close to a main road where it will be visible and easily accessible. To place it further away makes the site less attractive. Also, given that it is an airport ( I have not looked at plan), maybe having building on the periphery might make more sense. Is the building lower or higher than currently existing hangars?" How can the ZBA expect these highway developments to generate such low traffic volumes when you consider all the costs involved from land acquisition, building, borrowing, taxes etc.. Does 10 to 15 cars per hour pay the bills for such a project? Likewise should the developer not know that with such a low threshold his project is not economically viable. Did they envision professional offices there? Brokers, lawyers, medical offices. Is the rent consistent with what they could afford?

What would be a highway business then? I don't exculpate the developer. He should have done a better analysis of what would work there or not. Likewise on the town approval side they should have some notion of what is workable or not. Otherwise we will end up with a whole lot of empty there, bankruptcy, no tax revenues, eyesores, etc. etc.. In light of the businesses that had given letters of intent, I do not see why a 7-11 would not qualify as a highway business. IMO its better to have one on the highway, as opposed to the village.
I suspect that when the zoning was done it was with the best of intentions. When the project was conceived and approved it was with the best of intentions by all. But now the underlying environment and assumptions have changed. The options could be stick to the plan,or zoning, or to accommodate it a bit. Why not try to make it work? " Jan 28, 11 1:55 PM

Nature, yes I had the audio running the whole time and had a different characterization than Razza about what I saw. Overall I don't feel she was swerving all over the road. Her first swerve we see on the video, as the police pull up behind her, is to the right. That was the biggest swerve. It came at the same time that an SUV was cumming from the other direction with their high beams on. She might have swerved to the right because of the lights as she looked away. I don't know. Then she proceeds normaly down to the corner and drives on the double yellow line, going over it slightly, and redressing back as a car came around the corner. There were parked cars on her right. That and the fact that she was about to make a left turn help explain why she was so far to the left. She swerved slightly and crossed the yellows but was not swerving all over the place. She approached the stop sign fast for my taste and in my opinion did not make a full stop. She proceeded down the road until pulled over without swerving all over the road. Even the officer said "you were swerving slightly" as his reason for pulling her over.

Breaking constantly. She braked noticeably on three distinct occasions. At the beginning of the video its not clear why to the viewer. Could it have been the high beam of the SUV or something else. Can't really tell. Then she was braking as she approached the intersection to slow down for her turn. Which I found too fast anyway. Then she had to brake again after the turn to allow the pedestrians to pass. She continued to drive until she was pulled over.

In no instance did I find her speech to be slurred. Her voice was crisp throughout. I think she digressed in certain places ,as you have pointed out. I did not hear the statements as clearly as you transcribe them. But they seem nonsensical and paranoid.

She's feeling victimized and defensive. I think we all loose it a bit when we are pulled over by a policeman. One moment your driving down the street and all is well, the next your pulled over by a policeman with the lights flashing the headlights on your car shinning at you. Your heart is bound to be racing and your adrenaline going as well. Your not going to be thinking or behaving at your best and most rational. Your put in a defensive position with an authority figure. Uncertain because you otherwise consider yourself a good driver and relatively sober in her case. All of a sudden your not. Your scarred. If you question too adamently your accused of disorderly conduct.Right? Add to that your public figure running for reelection and here you are exposed in the middle of main street. On top of which you stood up to the Police union and you fear this is payback. That I think is the mindset she put herself in and came to believe as truth. Or just an elaborate scheme for self-defense. I don't think she was that calculating at that point.

Her sobriety tests are not to clear to me. I luckily never had to take one. I see what you claim about not understanding instructions. In the first test, even the officer moves his head when giving her the instructions about following his finger and not moving her head. She got it on the second or third pass. What that is supposed to indicate to the officer? I don't know.

Then test two, it was messy at first. It seemed more like a dancing lesson than a sobriety test. And, if you have ever taken dancing lessons you would understand why sometimes the simplest instructions of what to do with your feet can seem more complicated. Anyway, what is more important: how fast you understand the instructions or how you perform the test? On fith step out of nine she stumbled. What is this suppose to indicate to the tester? I don't know. But she did not loose her composure and continued to the ninth step ok. Then she walked backward. Was she supposed to or turn around? I think the officer wanted her to turn around and walk back and not backwards. Again I don't pretend to know what that is supposed to indicate. I noticed that the officer did not interupt her though either.

Test number three, the leg lift and count. She did it as I recall without stumbling. She only interupted after 10 one thousand to find out from the officer how much longer to go. I tried that test myself sober two cups of joe and had problems with my balance. In my opinion, that test is only good to indicate whether you have good balnace or not. I don't see what it can tell you about sobriety because I think that if your drunk your not gonna last 20 seconds.As she did.

All in all I think she was cooperative with the officers and the tests. A little incredulous and fiesty here and there yes. But she went along. Then they disappear for four minutes into their cars turn off the microphone to the cam.

The officers claim they were testing the cam because they wanted to make sure it was working since they had a high profile DWI. That is what they testified to and not on the video. I am no expert on dashboard video but I cannot tell that they were testing the cam. The cam stays on the whole time and the microphone off. I see no indication of a cam going on and off to make sure it is working or a microfone likewise going on and off . You know the old "test test test".

I think that this gap in the sound on one of the most important pieces of evidence is significant. The jurors are only allowed to see the parts about Kabot, but they are not privy to the discussions between the two officers or third parties? What was being discussed?What was she observing standing for four minutes on the street? This is key to me because it is when they come out of the car, after that lull, that her cooperative demeanor changed. She for one reason or another decided she was not going to play along anymore come what may. Was it the fact that she was left to stand there in the middle of the village in front of the police car flashing lights and lights on her for four minutes for all to see that humiliated her and pushed her to become uncooperative? Could be. (I could not help but notice the number of police vehicles passing the scene during this tape. One cruiser at the beginning passed them, then a little later an SUV police vehicle, and then a police golf cart. Was that coincidence?) I s it standard DWI procedure to let the driver stand so long outside their vehicle. When ever I have been stopped, as driver or passenger, the police always asked to stay in the car.

After the gap incident for whatever reason she said enough. Several times she explained what she wanted to do and why she did not want to take the breathelizer. The police officer explained to her the consequences. She clearly explained why she would not take the test. Rightly or wrongly she accepted the consequences. Nothing indicates to me that she did not understand what was going to happen to her. Whether she was victimized, or playing the victim card, her sobriety was no longer the issue at that time but her reaction to the situation. In my opinion, I think the officers were more than likely doing their work when the situation started out, as they would do it with any one of us, it only became complicated when it became Linda Kabot. Likewise I thing her victim instincts may have gotten the better of her. She should have just taken the test based on what I've seen. I just did not agree with the out of control drunk driver characterization.

Well I think they are interesting to watch and a learning experience. I have learned a few things and can now practice sobriety tests. The follow my finger don't move your head test, the toe to heal imaginary line test when i say go test, the lift one leg and count until i say you can stop test...Are there anymore? My experience with a side of the road breakdown in SH has been different. The officer tried to help me as much as he could. And only left after I called the auto club.

Granted there have been a lot of violent drug related crimes here recently and it seems that the SH has had some success in staying on top of those. There has always been a drug trade out here. But it seems that that trade is changing from a small time dealer to a more violent and gang related business. The battle against this is not just a local police matter as we see with today's bust of a gang by the task force. So in that context it is acceptable that the officers have good salaries. But then we need undercover cops and not what we essentially have now and complain about: highly paid transit officers. Lengthy testimony ensued about the recording of Kabot’s arrest. Gonce said he has the first and original recording in his office, but said it is not labeled as such.

“Did there come a point in time when Officer McManus and Officer Lucas asked for a copy?” asked Gonce.

Gonce said the officers, who stopped and arrested Kabot, had asked to review the “first copy” that he had in his office.

They took the copy, he said, and “when they were done, the put it under the door.”

Gonce testified that he did not know how long the pair had the recording but that depending on his shift, it could have been between one and four days.

“Do you know what they did with it?” asked Keahon.

“I’m assuming they viewed it," Gonce responded.

Gonce testified that when he first viewed the tape, he did not see the gap of more than three minutes with no video. He testified that he noticed the gap after the ADA pointed it out to him.

Gonce also said the video was never placed into a locked evidence locker because it was requested immediately by the district attorney’s office.

And then the report concludes

[ADA]Shapiro mentioned the tape as it related to Officers McManus and Lucas, and said to the judge that there had been “no testimony that evidence was destroyed.”

“Oh, I wouldn’t be so sure about that,” said [Judge] Smith, adding that first, testimony had been heard about the digital recording being taken from the hard drive in the police car. Then, he said, testimony ensued and, “Oops!” he said, “a gap” in the tape was discovered a few months later.

“That’s the testimony,” said Smith.

Tampering with evidence to boot.
