Police Suspension May Hint At Issues In Department

“When we did cases, like on the reservation, we couldn’t even include Southampton—we couldn’t let them know anything, because they couldn’t be trusted,” the agent said. “Southampton just didn’t play well with others.”

Under Chief Overton, the Town Police relied on the Street Crime Unit to conduct its undercover investigations of drug sales in the town, rather than participate in the East End Drug Task Force, a multi-jurisdictional unit that uses officers from other departments to conduct undercover work within a department’s protection area so as to make concealing the identity of undercover officers easier. The Town Police began participating in the task force again last year, after Chief Wilson took over, and the Street Crime Unit was disbanded after more than 20 years in November.

Lt. Kiernan, a 15-year veteran of the Town Police force, was placed on leave by Chief Wilson last month. He was promoted from sergeant to lieutenant just last October on the chief’s recommendation, one of the first promotions he gave out after becoming chief in May 2011.

Chief Wilson would not comment on the charges he has leveled against Lt. Kiernan because he said he is prohibited from discussing internal personnel matters. Likewise, Town Board members largely declined to discuss the matter at all, beyond confirming that they met with the chief prior to calling the special meeting at 4 p.m. on Friday.

Mr. Nuzzi said he was absent from the vote because of a prior family obligation and was not aware that the special meeting had been called. On Monday afternoon, he said he wished the board could have held off on the vote until Tuesday’s board meeting so that he could have been present. He would not say if he would have voted in favor of the suspension or against it.

Other board members said that they felt that in light of the charges the chief was presenting them, they felt obligated, and were advised by the town’s labor attorney and the town attorney, to call the vote on the suspension immediately.

“For all intents and purposes, there were four or five attorneys in the room … and as the matter was presented to us, and what the standard of review is, if we were going to make a determination, we needed to proceed at that time,” Councilman James Malone said.

Mr. Malone, a Conservative Party member who was endorsed in the 2009 elections by the Republican Party, was critical of the chief’s appeal to the Ethics Board to have Mr. Nuzzi and Ms. Scalera recuse themselves from the vote and from future consideration of the charges against Lt. Kiernan.

“If you start going down that road, you’ll have nobody in the room,” he said. “If James Kiernan were a registered member of the Independence Party, anybody who received the Independence Party line in the last election would have to recuse—that would be me, that would be Bridget [Fleming], that would be the supervisor, Councilman Nuzzi and Councilwoman Scalera—in which case, who would be voting? So I don’t follow the scenario he’s presenting of the potential conflict.”

Ms. Scalera said she was not aware of the ethics inquiry and declined to comment on it other than to say she found it “very troubling and upsetting.”

Mr. Nuzzi said he was not aware of the Ethics Board inquiry regarding his vote.

Why is it, that while the other four council members were working and able to cast their vote, Nuzzi was not present? From what I heard, Nuzzi was present... and at town hall... but stormed out. Only to be seen in front of Scottos in HB, flailing his arms like a leprechaun who just lost his gold, while on a cell phone! So much for working for the people.

Unless you were an absolute witness that Nuzzi did that, don't spread something that you heard. Nuzzi is a good guy and I have never seen him run from anything. While your comment might a particular cuteness about it, don't to it at the expense of someone's reputation.

A unanimous vote across party lines? That says one of two things, either the town board is finally thinking about the public and logically voting ( of course not Nuzzi) or these charges are so bad they had to act

Where was Nuzzi? If four votes were cast by councilpersons to suspend this individual, there must be something amiss. Unless Nuzzi had a good reason not to be there, his absence is suspect.

Actually, the civil service law protects some documents from FOIL requests for such reasons.

Kiernan needs luck because he is being railroaded in the who's got the bigger salami war between the chief and the politicians and both sides are willing to feed him to the wolves for their personal gain. By bringing in an outside puppet (Wilson), who's in over his head, ATH and her ilk, PBA etc, are finally getting their wishes by getting rid of the supervisors who actually demand that the officers of the police department "work" for the tax payers of Southampton. What you fail to mention is that the suspension was unanimous 4-0. Nuzzi was absent. Whatever the issue, it was enough to cause the entire Town Board to vote for suspension. Kiernan will have the opportunity to have his side heard at a hearing. The Board could have suspended him without pay, thus he was able to maintain his medical benefits. And what YOU have failed to note, Crusader, is that the Town Board knows only what Chief Wilson has told them.

The Lieutenant has yet to be heard from, but as a matter of law, WILL have his day.

But if you think back to who lined the walls of the meeting room when Wilson was appointed Chief, it wouldn't surprise me if this entire thing was as a result of the Town PBA having "their guy" prefer charges of some sort again Superior Officer Kiernan.

Tony Tenaglia would have been chief for only a very, very, very short time. The poor man is suffering from a 26 yr. old injury that put him out to pasture way too soon. Basically, right after he did not make chief.

Also what YOU fail to mention is that of course they've only heard the chiefs side, he is the top law enforcer in the town and brought his findings to them. The good Lt will have his day to speak his case but I hope it's a good case ESP with the 4-0 vote to suspend.

Newsy items like this shouldnt be in the press unitl they do their investigation and know that there is an issue. Then it should come out along with why it happended. There shouldnt be any confidentiality with public servants as we need to know what is going on with our tax dollars wheather its a person or a project.

One would think that the filing of 32 charges against a Southampton Police lieutenant is very important in Southampton. Now the Suffolk DA has seized records and both Federal and State law enforcement have not advised the Southampton Police on any investigations. Just what is going on here?

Mr. Editor,

Perhaps an update on this story is needed because this morning, the Suffolk DA, as a result of a supoena, descended on Town Hall and removed seven cardboard boxes containing Southampton Town Police personnel files.

I have a feeling there is a lot more to come on this story.

Nuzzi wasnt aware of the meeting. I heard he stormed out and went to Scotto's for lunch (great food by the way) and was jumpimg around outside like a baby. This guy is a disaster. Cant do your job, then leave. Or stick with typing title search approvals or rubbing elbows with those sand and blacktop guys. Disgrace using your family as an excuse. Time for a change people - across the Board !

I share with those of you who go back decades with the STPD.. A humble opinion:
"Bigger in this case, day and age,Bigger is Not always Better"...
Mid sixties through subsequent decades the township operated with local homegrown cops... Schooled here.. Raised here.. Worked home sectors.. Brought their families up here.. Had pride to have that car seen in their driveway and so too were their neighbors.

There are cops on the Southampton Town Police force who are homegrown, who do take tremendous pride in the fact they get to serve the community, are very thankful that they get compensated as well as they do, and work as hard as they can to earn it. One of my best friends is a town cop, that guy gets people on his front porch, calling his home phone, approaching him at the 7-Eleven, with his kids. So let me get this straight readers, the new Chief Wilson had asked for Chris Nuzzi to recuse himself from the hearing b/c of party affiliation. Nuzzi had asked for the hearing to be scheduled on the day of the board meeting b/c he could not attend the last min hearing due to a family obligation, and yet they still went ahead with the hearing? It is also fact that Nuzzi was a member of Lavalle's Brookhaven Town administration when corruption charges were leveled by Spota which resulted in prosecution. Lavalle chose not to run for reelection. Nuzzi then returned to Southampton politics. His mentor, LaValle is now Suffolk GOP Leader. The ...more

I've met councilman Nuzzi several times and i have to say the bashing on here about him is totally unmerited. He is down to earth and puts the interest of the residents as his primary concern. Whether you agree with him or not he has always tried to do right for the people of southampton. The p.d. has definately gotten themselves in a bit of a sticky situation, but it has nothing to do with Mr. Nuzzi.

Obviously, since no other law enforcement agency in New York respects the STPD it is time to disband. Turn it all over to Suffolk County as it is handled in most Suffolk Towns. Only the east end still has these little police departments - which are a breeding ground for corruption, nepotism and wasteful spending.

There is one thing to lbe said about local control in local police dept. as opposed to bring in the Cty. police. Sountampton's DNA has included the summer influx of (in the past) the ultra wealthy. They presented different situations which the county police did not have to live with day in and day out.

Spota successfully prosecuted a number of Brookhaven employees for corruption during LaValle's tenure as Supervisor. Nuzzi was part of LaValle's administration in Brookhaven. LaValle decided not to seek reelection after this occurred. Make whatever you choose out of this.

Hey,Kahuna in tampa...I think you nailed it.. Back than we did a lot more with less. My first week on the job I asssisted with a child birth, a l6 year old mother and had no backup because I was the only cop on duty in western Southampton Town. That was from the Brookhaven Town line to the Shinnecock canal. Thats how it was done in the mid 60's. My salary was $4400 per year and no overtime. BTW, it's the Southampton Town Democratic Committee, not "Southampton Town Democrat Committee" as you put it. Nonetheless, there is a problem in Southampton Town. Too many unanswered questions which I hope the Southampton Press keeps investigating. Partisan politics aside, whoever is found to have committed violation(s) of statutes should be prosecuted. If they happen to be an elected official, all the more reason to expose any wrongdoing.
